TERMS AND CONDITIONS

1. General
1.1 These general terms and conditions apply to all agreements between Shop for Covers B.V. and the customer. By placing an order, the customer indicates that he agrees with our delivery and/or payment conditions. The agreement is concluded at the time of acceptance of the offer and compliance by the customer with the associated conditions.
1.2 Shop for Covers B.V. can adjust its delivery and/or payment conditions at any time in the event of changed insights. These terms and conditions apply to every agreement between Shop for Covers B.V. and the customer to whom Shop voor Covers B.V. has declared these conditions applicable. This insofar as the parties have not expressly deviated from these terms and conditions in writing.
1.3 The goods offered are depicted and described as clearly as possible.


2. Prices
2.1 As long as the agreement has not been concluded, Shop for Covers B.V. at all times authorized to change the prices stated in the web shop and the further conditions.
2.2 All prices in the web shop include sales tax and exclude shipping costs. The costs for shipping are indicated in the menu 'Shipping costs' and also in the shopping cart.


3. Payment
3.1 Payment is made by “Ideal”, Credit Card, PayPal or advance payment via bank or giro and must be paid within 8 days after an order has been placed and therefore the purchase agreement has been concluded in the absence of which Shop for Covers B.V. is entitled to charge statutory interest to consumers and statutory commercial interest to business customers.


4. Delivery
4.1 Once payment has been made and has been received by Shop for Covers, your package will be composed with the items you have ordered. In general, items ordered before 3 p.m. are shipped the same day. Orders are delivered to the address specified by the customer by DPD (www.dpd.nl) or UPS.
4.2 If you are not at home when the delivery person visits the specified address, please leave a message. It states how you can schedule a new delivery. After two unsuccessful delivery attempts, your order will be sent to Shop for Covers B.V. sent back. In this case, please contact us and we will send your order to you again against payment of the additional shipping costs.
4.3 Despite all the care we take with orders, it is possible that an order is not or is incomplete. , will be delivered. In that case, you can report this to us by e-mail up to 14 days after your order and the delivery may be supplemented or redone at our expense.
4.4 Shop for Covers B.V. bears the risk of damage and loss of the articles during transport. After the items have been received by the customer, the risk of damage and loss passes to the customer. 4.5 Shop for Covers B.V. is authorized to change the order if it concerns adjustments that imply a qualitative or improved functionality of the product. The applicability of Section 7:755 of the Dutch Civil Code is expressly excluded.


5. Retention of title
5.1 Delivered items remain the property of Shop for Covers B.V. until you have fulfilled all your    (payment) obligations. This applies regardless of which delivered item the payment obligation has arisen.
5.2 Shop for Covers B.V. is irrevocably authorized, as soon as the customer is in default with regard to any obligation whatsoever, to return the items that are the property of Shop for Covers B.V. have remained with the customer to take back.


6 . Right of return
6.1 If the customer wishes to return an unused/undamaged/uncontaminated item, this can be done by sending your return notification to info@shopforcovers.com within 365 days of receipt. You will then receive instructions to return the unassembled and undamaged article with all original labels attached to the article in the original, undamaged packaging to:

The customer has the option to remove the product from the packaging, view it, assess it and try it on, without causing any damage or traces of use. In short, you can try the product as you would in a store.

Excluded from returns:

  1. On request of the personalized items such as printed items or custom-made items.
  2. In use items with visible signs of use.
  3. Sale items, heavily discounted items due to an outlet offer or a limited offer.
  4. Goods that are in the possession of the customer for more than 365 days.
  5. Installation, installation and assembly costs.
  6. Costs for a special shipping option such as evening delivery, weekend delivery or time slot delivery.

 

6.2 Shop for Covers BV must be informed of the shipment by E-mail prior to the return shipment. The E-mail address is: info@shopforcovers.com
6.3 Shop for Covers BV will refund the purchase amount minus the shipping costs within 5 days after receipt of your return. The shipping costs for returning an item are for your own account and may be deducted from the amount to be credited.
6.4 We are not allowed to receive unstamped shipments.
6.5 In case of return shipment, the customer bears the transport risk. After the items have been received by Shop for Covers BV, the risk of damage and loss passes to Shop for Covers BV.
6.6 In case of cancellation of the custom-made Custom Cover cover while it is already in production, A 50% deposit applies which will not be credited.
6.7 Shop for Covers will not be allowed to take back a soiled, visibly used or damaged cover.
6.8 Discoloration of the cover is not a reason for return or warranty and Shop for Covers will not be allowed to take back.
6.9 SALE items, which are on sale, may not be returned with a refund of the purchase price. These SALE items may only be exchanged for an item with an equivalent price or for an item with a higher price with additional payment.

 

7. Liability and guarantees
7.1 Shop for Covers B.V. is not liable for advice it provides, any incorrect entries on the website and/or printing and typing errors on promotional material, technical data provided by suppliers or producers.
7.2 Shop for Covers B.V. makes no guarantees about the content and operation of the website. Shop for Covers B.V. accepts no liability whatsoever for defects in this website, problems with calling up and ordering articles.
7.3 Exclusion of liability does not apply to damage that is due to intent or gross negligence on the part of Shop for Covers B.V. or persons for whom it is legally liable and this liability cannot be excluded, in which case the liability is limited to compensation for direct proven damage to persons or property, not including loss of data.
7.4 Shop for Covers B.V. is not liable for (indirect) damage that arises during the use of our products. In reasonable 'normal use' and in accordance with the regulations issued, the products do not cause any damage.
7.5 Warranty is issued on:

  1. Broken stitching, with normal use (2 years)
  2. Releasable seals (2 years)
  3. Breathability, membrane functioning (5 years)
  4. Defective bag, zipper and handles excluded (2 years)
  5. UV resistance (2 years)
  6. Printing (2 years)

7.6 Warranty is not issued on:

  1. Damages due to incorrect use
  2. Water repellency, for this the cover will have to be treated periodically by the customer in accordance with the maintenance instructions determined by Shop for Covers BV.
  3. Zipper and handles of the bag.

 

8. Force majeure
8.1 Under force majeure, in addition to the provisions of art. 6:75 of the Dutch Civil Code: Extraordinary circumstances, such as storm damage and other natural disasters, full or partial strikes by third parties or government, riot, war or danger of war both in the Netherlands and in the country of origin of the materials, exclusions, loss or damage of matters during transport to Shop for Covers B.V. whether the customer, not, improper or late delivery of goods by suppliers of Shop for Covers B.V., ex and/or import bans or restrictions, full or partial mobilization, obstructive measures by any government, fire, malfunctions and accidents in the company or in the means of transport of Shop for Covers B.V., or in the means of transport of third parties, the imposition of levies or other government measures, which entail a change in the actual circumstances, deliver for Shop for Covers B.V. force majeure, which release it from its obligation to deliver without the customer being able to assert any right to compensation of any kind or by whatever name.       
Shop for Covers B.V. is in these or such cases entitled, at its own discretion, to dissolve the agreement with the customer or to suspend or amend it, respectively, until the force majeure situation has disappeared.           
8.2 Shop for Covers B.v. also has the right to invoke force majeure if the circumstance that prevents (further) fulfillment occurs after Shop for Covers B.V. should have fulfilled its obligation.
8.3 During force majeure, the delivery and other obligations of Shop for Covers B.V. suspended. If the period during which the fulfillment of the obligations by Shop for Covers B.V. is due to force majeure. If it is not possible for longer than 3 months, both parties are authorized to dissolve the agreement, without there being any obligation to pay compensation or undo.
8.4 If Shop for Covers B.V. has already partially fulfilled its obligations at the commencement of the force majeure, or can only partially fulfill its obligations, it is entitled to deliver the already delivered or the deliverable part separately. However, this does not apply if the part already delivered or deliverable has no independent value.


9. Privacy
9.1 On the website of Shop for Covers B.V. general visitor data is kept. The purpose of this is to optimize the layout of the website for you. The data may also be used to put more specific information and offers on the site for you. In this way we can further optimize our services to you.
9.2 We use the established legislation when using your personal data. Shop for Covers B.V. only uses the customer's data for (internal) marketing purposes, such as sending newsletters.
9.3 Shop for Covers B.V. will under no circumstances pass on your data to third parties. At the first request of the customer, personal data of the customer will be removed.


10. Other provisions
10 All agreements between Shop for Covers B.V. and the customer is subject to Dutch law. For business customers, only the courts have jurisdiction within the district where Shop for Covers is located.


11. Printing
11 Our covers may be printed. When the customer chooses to have the cover printed, it can no longer be printed by Shop for Covers B.V. be taken back.
